Definitions:
- "BEC" means the Business Education Council of Niagara
- "System" means BEC Internet services and related computer systems
- "Content" means any electronic files, including messages, stored on or
transmitted via the Internet
- "Owner" means the person(s) or other entity listed on BEC's registration
documentation
By accessing BEC Internet services, I the Owner of purchased services understand and agree
that:
- I must abide by the terms and conditions contained in this Agreement. The BEC
may modify the Agreement at any time without prior notice. If at any point I do not agree
with the Agreement, I will immediately stop using BEC services and inform the BEC of such
decision.
- I will provide accurate and current information as required by the registration
process, and promptly update such information as necessary to ensure that it is accurate
and complete. Falsification of information may cause termination of service.
- Only the Owner has authority to request that BEC modify my services and
associated information.
- The BEC cannot guarantee availability, bandwidth or other performance of any
service at any location, nor that any particular computer system will be compatible with
BEC Internet services.
- I am responsible for the use of my BEC Internet services and for maintaining
confidentiality of passwords. I am fully responsible for the online conduct of any other
person whom I authorize to use my BEC services. BEC shall not be responsible or liable in
any way for loss or damage of any kind incurred in connection with failure to comply with
this section.
- I am responsible for the security and privacy of my computer systems and
Internet use. BEC is in no way responsible for loss or damage resulting from any form of
security breach.
- I agree to promptly pay all incurred charges as per the current BEC Services
price schedule. Failure to comply will result in suspension of service. The BEC reserves
the right to recover all unpaid fees.
- In the case of pay-as-used service features, such as data transfer fees, data
from BEC's server logs are definitive and final.
- I may have access to Internet content that may be offensive or dangerous. Under
no circumstances shall BEC be responsible or liable in any way for loss or damage of any
kind incurred in connection with access to such content.
- Service will be terminated immediately without compensation for fraudulent,
illegal or criminal activities. Such activity includes, but is not limited to: any
malicious activity; storing or transmitting unlawful content; security attacks; integrity
violations; privacy violations; falsification of identity; harassment; causing System
degradation; interfering with any person’s use of Internet services; the use of
objectionable content in public (or, upon registration of complaint, in private) messages
or other Web fora; violation of this Agreement. The BEC, in its sole discretion, will
determine what activity or content constitutes a violation and what action will be taken in
response. Upon termination of service, the BEC will take control of content associated with
that service.
- The BEC may, in its sole discretion, remove or refuse to host any publicly
available content.
- Engaging in unsolicited commercial advertising by mass electronic mailings
(commonly called spamming) will result in termination of service. The BEC will be the sole
arbiter in deciding whether conduct qualifies as spamming.
- The BEC complies with Canada’s Personal Information Protection and Electronic
Documents Act and abides by BEC’s Privacy Policy (http://www.becon.org/privacy).
- The BEC may monitor and investigate System usage and disclose information as
required by law.
- The BEC may monitor and investigate System usage for the purposes of ensuring
compliance with this Agreement, protecting the network and BEC clients, and for normal
network management.
- Information provided on or obtained via the System is not a substitute for
professional consultation. The BEC assumes no responsibility for any information accessed
on or via its Internet services.
- When using BEC Internet Services, correspondence or business dealings with any
third parties (including merchants or advertisers, including payment for and delivery of
related goods and services, and all other terms, conditions, representations and
warranties), are solely between such third parties and me. The BEC assumes no
responsibility whatsoever for any charges incurred when making transactions. I assume
responsibility for ensuring compliance with all applicable laws. BEC shall not be
responsible or liable in any way for loss or damage of any kind incurred in connection with
any online transactions.
- Using the System for transmission or storage of copyright-protected material
without proper authorization may be an infringement of Canadian law and could incur
criminal and civil liability. BEC does not authorize the use of its Services in any way
that is contrary to law.
- The BEC does NOT warrant that the functions of this System will meet any
specific
requirements I may have, or that it will be error-free or uninterrupted. The BEC shall not
be liable for any damages whatsoever (including lost data or profits) incurred in
connection with the use of, or inability to use, the System.
- The BEC may at any time add, modify or discontinue any services.
- The BEC may discontinue or refuse to offer any service to any person or
entity.
- I release the BEC, its operators, and any institutions with which they are
affiliated, from any and all claims of any nature arising from my use of, or inability to
use, the System.
- I will indemnify the BEC for any loss suffered by it by reason of my improper
use of the System, and compensate anyone harmed by my abusive use of the System.
